Clinton Voter Sentenced to 35 Years in Prison Over Fatal Argument About 2016 Election

The Associated Press reported today that a California man who voted for Hillary Clinton in the 2016 presidential election has been sentenced to 35 years in prison after shooting his bandmate and killing his bandmate’s wife after being teased about backing Clinton.

According to the AP, “John Kevin McVoy Jr., 40, of Corona, received the maximum sentence Monday after being convicted of murder last month.”

Though his lawyers claimed self-defense, McVoy was found guilty of murder, as well as bringing a loaded weapon into a residence and pointing it at somebody last November after he shot his bandmate, Victor Garcia, and killed his wife, Susan Garica, who was holding their small child:

“McVoy was in a garage band with Victor Garcia. During practice on Jan. 10, 2017, the two got into an argument over politics at Garcia’s home in North Long Beach, prosecutors said.

McVoy pulled a gun after he was teased for saying he had voted for Hillary Clinton and Garcia told him to leave, prosecutors said.

The mother was reportedly in a coma for months, undergoing multiple surgeries, before succumbing to her injuries.

The band was apparently watching President Barack Obama give a speech that day. A witness testified that he poked fun at Garcia for supporting Donald Trump, “something Victor Garcia denied.”

However, when McVoy said that he had voted for Hillary Clinton, Garcia allegedly made a joke against McVoy and told him “Get the f*** out of my house.” The witness in court stated that everybody laughed.

That joke led to the aforementioned sequence of events that led to Susan Garcia’s death.

The Press-Enterprise also reported that McVoy claimed that Garcia was the one who first became violent, even making racist comments toward the white Clinton supporter:

During testimony, McVoy said he tried to calm Garcia down after Garcia had made racist comments, and pulled the gun and fired after Victor Garcia grabbed an object from the table and began raising his arms toward McVoy.

McVoy testified that Garcia approached him with the object, a can opener that McVoy initially believed could have been a knife.

But, a witness testified that the story was false:

“It’s all contrived by McVoy,” Lee said of his testimony. “His account makes no sense when considering the evidence.”

“He’s the one that made this something else,” she said. “There was no imminent danger at the time.”
